Terms Of Service

By using our services, you agree to these terms. Please read them carefully.

Using our Services

You must follow any policies made available to you within the Services. Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.

Our Services display some content that is not ours. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

Student Data Privacy and Compliance

Radius is committed to protecting the privacy of student data and is fully compliant with applicable laws, including the Family Educational Rights and Privacy Act (FERPA) and the Children’s Online Privacy Protection Act (COPPA).

FERPA Compliance

  • Radius acts as a "School Official" under FERPA, processing Student Data solely on behalf of the Educational Institution (school, district) using our services.

  • Student Data is collected, processed, and stored only as directed by the Educational Institution and is not used for advertising or profiling purposes.

COPPA Compliance

  • For users under the age of 13, Radius requires that Educational Institutions obtain parental consent on behalf of the student, as permitted under COPPA.

  • Radius does not directly collect any personally identifiable information (PII) from students under 13 without parental consent facilitated by the Educational Institution.

Student Data Usage

  • Student Data is collected for the sole purpose of providing educational services.

  • Student Data will not be used for marketing, targeted advertising, or profiling.

  • We maintain strict access controls, limiting access to Student Data only to authorized personnel.

Data Retention and Deletion

  • Student Data is retained only for the duration of the educational purpose or as directed by the Educational Institution.

  • Upon request from the Educational Institution, Student Data can be deleted at any time.

Security Measures

  • Radius implements industry-standard security measures to protect Student Data, including encryption, access controls, and regular security audits.

Student Data Privacy Addendum

This policy is supplemented by our Student Data Privacy Addendum, which outlines additional protections for Student Data processed under agreements with Educational Institutions.

Individual Users and Parental Consent

If you are using Radius independently (not through an Educational Institution), you are solely responsible for obtaining parental consent before sharing any student-facing features, including Quests, with students under the age of 13.

Radius does not directly collect any personally identifiable information (PII) from students without parental consent. Any misuse of student-facing features with minors without consent may result in account suspension or termination, as well as other legal consequences.

Your Google Account

You may need a Google Account in order to use some of our Services. You may create your own Google Account, or your Google Account may be assigned to you by an administrator, such as your employer or educational institution. If you are using a Google Account assigned to you by an administrator, different or additional terms may apply and your administrator may be able to access or disable your account.

To protect your Google Account, keep your password confidential. You are responsible for the activity that happens on or through your Google Account. Try not to reuse your Google Account password on third-party applications. If you learn of any unauthorized use of your password or Google Account, follow these instructions.

Google Privacy and Copyright Protection

Google’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Google can use such data in accordance with our privacy policies.

We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers.

By using our services, you acknowledge and agree that our service utilizes the Google Services. Therefore, by using our services, you are also bound to the Google Terms of Service (ToS).

YouTube API Services

By using our services, you acknowledge and agree that our service utilizes the YouTube API Services. You are bound by the YouTube Terms of Service (ToS) and the Google Privacy Policy.

We only access public YouTube content, and we do not store any personal data from your YouTube account. We store only video URLs and basic metadata (such as titles, descriptions, and thumbnails) strictly for educational purposes.

We do not collect, store, or process any personal information from your YouTube account without your explicit consent.

All interactions with YouTube content through our services are governed by YouTube's Terms of Service and Google Privacy Policy.

Credit Usage

Credits are part of our subscription plans and are used to access certain features of the Service. Unused credits may roll over or expire based on the terms specified in your subscription plan.

Cancellation and Refund Policy

You may cancel your subscription at any time. Specific terms regarding cancellation, including any required notice period and potential penalties, are detailed in the cancellation policy section. Our refund policy outlines the conditions under which refunds are processed and the procedure for requesting a refund.

Modifications to the Service and Termination

We reserve the right to modify or terminate the Service at our discretion for reasons including, but not limited to, compliance with legal obligations, changes in business strategy, or circumstances that necessitate adjustments. Users will be notified of substantial modifications or termination in advance, where feasible.

In addition, we may suspend or terminate accounts or restrict access to the Service in cases of excessive usage or conduct deemed unlawful or unethical, including but not limited to activities that infringe intellectual property rights, violate the privacy of others, disrupt network performance, or abuse the Service in any manner. The decision to suspend or terminate will be made at our sole discretion, and any such action will be communicated as appropriate.

User Responsibilities

You are responsible for using our Service lawfully and ethically. This includes not infringing on intellectual property rights, not sharing illegal content, and maintaining the confidentiality of your account information.

Disclaimer of Warranties and Limitation of Liability

We provide our Service "as is" without any express or implied warranties. Our liability in connection with the Service is limited to the extent permitted by law.

Guidelines for Using AI-Generated Content in Educational Settings:

  • Initial Draft Use: View AI-produced materials as preliminary drafts that need your expertise to reach completion. Typically, these should be seen as 90% finished, requiring your input to perfect the final 10%.

  • Critical Review for Integrity and Bias: AI technologies can sometimes introduce errors, biases, or unverified information. It is imperative to scrutinize the content for these issues before it is utilized in an educational context.

  • Update and Context Awareness: Keep in mind that our AI’s knowledge base is current only through the end of 2023. For topics beyond this date, additional verification from up-to-date sources is necessary.

  • Personal Information Caution: Do not input or process personal identifiable information of any individuals within our service. Violations of privacy laws or institutional policies can lead to severe consequences, including the termination of your access to our services.

Liability Shield Agreement:

As a user of our services, you agree to absolve and safeguard Radius, its executives, staff, representatives, and third parties from any legal claims, damages, responsibilities, and costs (including legal fees) incurred due to non-compliance with our Terms of Service, unauthorized usage of our services, or infringement of any proprietary, privacy, or personal rights. Radius retains the right to manage the legal defense against such claims at its own expense and requires your full cooperation in defending against these claims under the terms provided here.

 

Privacy Policy

Information we collect

We collect personal information only as necessary to provide educational services.

Student Data includes nickname, progress, and activity data within our educational services.

We do not collect or process personally identifiable information (PII) of students without parental consent obtained by the Educational Institution.

For Educational Institutions using Radius services, please refer to our Student Data Privacy Addendum for additional protections.

By using Radius, you acknowledge and agree that our service utilizes Google services, and that we collect information to provide better services to all our users. Therefore, by using Radius, you are also bound to the Google Privacy Policy.

Radius collects information about the videos you watch through our service. This information is used to improve content recommendations and user experience. We do not store any personal information from your YouTube account or any other personal data that could be used to identify you without your explicit consent.

Your interactions with YouTube content accessed through Radius are governed by the YouTube Terms of Service and Google Privacy Policy. We encourage you to review these documents to understand how your data is handled by YouTube and Google.

Data Retention

Student Data is retained only for the duration of the educational purpose or as directed by the Educational Institution.

Upon request from the Educational Institution, Student Data can be deleted at any time.

We collect information in the following ways:

  • Information you give us. For example, many of our services require you to sign up for a Google Account. When you do, we’ll ask for personal information, like your name, email address, telephone number or credit card. If you want to take full advantage of the sharing features we offer, we might also ask you to create a publicly visible Google Profile, which may include your name and photo.

  • Information we get from your use of our services.. We may collect information about the services that you use and how you use them, like when you watch a video on YouTube, visit a website that uses our advertising services, or view and interact with our ads and content. This information includes:

  • Device information We collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). Google may associate your device identifiers or phone number with your Google Account.

  • Log information When you use our services or view content provided by Google, we automatically collect and store certain information in server logs. This includes:

  • Location information When you use Google services, we may collect and process information about your actual location. We use various technologies to determine location, including IP address, GPS, and other sensors that may, for example, provide Google with information on nearby devices, Wi-Fi access points and cell towers.

  • Unique application numbers Certain services include a unique application number. This number and information about your installation (for example, the operating system type and application version number) may be sent to Google when you install or uninstall that service or when that service periodically contacts our servers, such as for automatic updates.

  • Local storage We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

  • Cookies and similar technologies We and our partners use various technologies to collect and store information when you visit a Google service, and this may include using cookies or similar technologies to identify your browser or device. We also use these technologies to collect and store information when you interact with services we offer to our partners, such as advertising services or Google features that may appear on other sites.

  • Information we collect when you are signed in to Google, in addition to information we obtain about you from partners, may be associated with your Google Account. When information is associated with your Google Account, we treat it as personal information.

Student Data Privacy Compliance

We comply with the Family Educational Rights and Privacy Act (FERPA) by acting as a "School Official" for Educational Institutions, processing Student Data only on their behalf.

We comply with the Children’s Online Privacy Protection Act (COPPA) by relying on Educational Institutions to obtain parental consent for users under 13.

Independent Use and Parental Consent

If you are an individual user (e.g., a teacher using Radius without an Educational Institution agreement), you are responsible for obtaining parental consent before sharing student-facing features, including Quests, with students under the age of 13.

We do not directly collect any personally identifiable information (PII) from students without parental consent.

How we use information we collect

We use the information we collect from all of our services to provide, maintain, protect and improve them, to develop new ones, and to protect Google and our users. We also use this information to offer you tailored content – like giving you more relevant search results and ads.

We may use the name you provide for your Google Profile across all of the services we offer that require a Google Account. In addition, we may replace past names associated with your Google Account so that you are represented consistently across all our services. If other users already have your email, or other information that identifies you, we may show them your publicly visible Google Profile information, such as your name and photo.

If you have a Google Account, we may display your Profile name, Profile photo, and actions you take on Google or on third-party applications connected to your Google Account (such as likes, reviews you write and comments you post)

Email address usage

We may use your email address to send you service-related notices (including any notices required by law, in lieu of communication by postal mail). We may also use your email address to send you marketing messages. If you don’t want to receive such messages, you may opt out by following the instructions in the message. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.

Changes to this policy

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).

Use of third party services

YouTube API Services

Our service, Radius, uses the YouTube API Services for educational content delivery. By using our service, you are subject to the YouTube Terms of Service and the Google Privacy Policy.

We access public YouTube content, including video URLs, titles, descriptions, and thumbnails. This data is used strictly for educational purposes and is not stored beyond the session unless necessary for educational resource functionality.

We do not collect, store, or process any personal data from your YouTube account without your explicit consent.

Additionally, Radius might use third-party services to collect and store information about your interactions with our service. These services may use cookies, web beacons, and other technologies to collect information about your behavior and device. This information is used to improve our services and provide you with a better user experience.

Age Verification and Parental Consent for Data Processing:

Radius requires users within the EEA to be at least 16 years old to use our services, except in countries where local regulations set a lower age (not below 13).

California Consumer Privacy Act (CCPA) Compliance

For individuals residing in California, this CCPA Privacy Statement applies, fulfilling obligations under the California Consumer Privacy Act (CCPA). Radius AI Systems, LLC respects your rights and makes it easy for you to exercise them.

Your CCPA Rights:

  • Right to Know: You can request details about the personal data we collect and how we use it.

  • Right to Delete: You can request the deletion of your personal data, subject to legal exceptions.

  • Right to Opt-Out of Sale: We do not sell your personal data.

Cancellation Policy

Scope of Cancellation Policy
This cancellation policy applies to all users of Radius AI Systems, LLC's services who have subscribed to our SaaS products via Stripe payments.

Initiating Cancellation

To cancel your subscription, you must submit a cancellation request through your account settings on the Radius platform or by contacting our support team directly at support@radius.ac. Cancellation requests must be submitted at least 24 hours before your next scheduled billing date to ensure processing is completed in time.

Effect of Cancellation

Upon receiving your cancellation request, we will immediately stop any future payments. Although no new charges will be applied to your account, you will continue to have access to your subscription services until the end of your current billing cycle.

No Refund Policy

Please be advised that Radius AI Systems, LLC does not offer refunds for any partial subscription periods or unused services. Your subscription services will remain active and fully accessible until the end of the current paid billing period.

End of Service

Once the current billing period concludes, your access to the current plan services and benefits will be terminated. You are responsible for ensuring that all necessary data or content is secured from your account prior to the end of the subscription period, as Radius AI Systems, LLC may not be able to retrieve or restore data once the account is closed.

Changes to Subscription

If you wish to change your subscription plan instead of cancelling it, you may do so at any time through your account settings. The changes will take effect at the start of the next billing cycle, and the new billing amount will be adjusted accordingly.
